Terms of Service

§1 Scope & contracting party
These terms apply to all users of Hospitly Elite (operated by Enrico Kaldasch). The contracting party of the users is Enrico Kaldasch & Pornvilai Kaldasch GbR, Ackerstraße 19, 04910 Elsterwerda, Germany. Hospitly Elite is a placement agency for private household staff — not an employer and not a staffing agency. We introduce searching households (clients) and professionals (candidates); the employment contract is concluded solely between household and professional.
§2 Test phase (beta)
The platform is in an open test phase (beta). Availability, features and content may change; uninterrupted or error-free use is not guaranteed in this phase.
§3 Services, fee & role
Use is free for candidates; candidates never pay any fee (§ 296 SGB III). If our introduction leads to an engagement, the client (household) pays a success fee when the professional starts; billing is by invoice. The amount and terms of the fee are communicated to the client individually and transparently before the engagement. If the placed professional leaves the position within three months of starting, we search again at no further fee (replacement guarantee); details are set out in the offer. There is no online purchase or booking with immediate payment obligation on the platform.
§4 Accuracy & verification
All information must be accurate; false information may lead to suspension. We check clients and placed positions before onboarding on a best-effort basis and to the extent possible in the respective country (incl. identity, contacts). The scope and depth of these checks vary internationally and are limited; they are not a guarantee of accuracy, legitimacy or solvency. Liability for information provided by third parties is excluded — users must still exercise their own due diligence.
§5 Notice-and-action (DSA)
You can report unlawful or fraudulent content to us at any time — a reporting channel is available per position, and additionally by email to info@hospitly.de. We review incoming reports and take the appropriate measures.
§6 Liability
Hospitly Elite provides the placement service and the technical platform and is not a party to the employment contracts concluded between candidates and households. There is no blanket exclusion of liability towards consumers; liability for intent, gross negligence, breach of cardinal obligations and for damage to life, body and health remains unaffected. Otherwise liability is limited to foreseeable, contract-typical damages.
§7 Account & deletion
You can delete your account yourself at any time — in the logged-in area “My area” via “Delete account”. Your personal data (profile, CV, applications, saved jobs) will be removed; invoice-relevant data is retained pursuant to § 147 AO for up to 10 years (see privacy policy).
§8 Governing law
German law applies. Mandatory market-specific provisions of the respective target countries remain unaffected.
